To President of the Republic,

We, the signatory entities watched in horror the negotiations that took place in the Federal Senate between the Minister Aldo Rebelo and the Leader of the Government, Senator Aloízio Mercadante, and also the floor and the opposition to vote regarding the project law of Biosecurity, sent by yourself, and approved in its entirety by the House of Federal Deputies. We, the signatory entities were in favor to the first project that the government sent to the Chamber of Federal Deputies. However, we were witnessing the project being completely changed, step by step, without any leaders of the government standing in defense for the project. On the contrary, they contributed to the disfigurement of the law project.

Now in the Senate, in spite of the open opposition by the Minister of the Environment, Marina Silva, and of the Civil Society, the Representatives of the Government approved in the Senate Commissions a substitutive that totally goes against the project law and that flagrantly violates various constitutional precepts, the project law sent by you.

Even more shocking to us, the signatory entities, was the news in the press that you are preparing to send to Congress a Provisional Measure incorporating this very unconstitutional substitutive measure which is contradictory to the project that was previously signed by you. All this process took place without allowing the Chamber of Federal Deputies to correct the changes introduced by the Senate on the Project Law (i.e. PL Projeto de Lei) that you wrote and that the Senate totally disfigured.

The proposition approved by the Senate Commission and that you are about to introduce as a Provisional Measure violates the Precautionary Principle from the Biodiversity Convention, the Convention of which Brazil is a signatory. The Provisional Measure allows for the liberation of transgenic without any prior studies of environmental impact or the risk of consumer health and also, the fact that such products brings no benefit to producer or Brazilian exporters.

Mr. President, you accepted, without hearing any alternative opinions, all the pro-transgenic propaganda from some scientists of EMBRAPA, the multinational companies of biotechnology and the soja producers of Rio Grande do Sul; the latter being fooled by apparent short term benefits.

We hope Mr. President, that you will not further extend the indiscriminate plantation of transgenic through the Provisional Measure and that the government restores its coherence in defending the Project Law as was presented by you to the Chamber of Federal Deputies; the law which guarantees environmental security for the consumers and national sovereignty which would be devastated by the Substitutive Measure mentioned above. We also consider as fundamental that local state governments be allowed to declare their territory to be transgenic-free if the people and the legislative assemblies opt for such, as has been the case in Santa Catarina, Paraná and Goiás. We also consider that it is fundamental that the people have the right to read on the labels whether the product contains Genetically Modified Organisms or not. Such a law has been approved, although not complied by the industries, and will be revoked through the current project proposed by the Senate.

Mr. President, the alarming inconsistencies and mistakes that the government is showing regarding this issue leaves the organized civil society in extreme frustration and disillusionment with your government, both in Brazil and abroad; the same that applauded the nomination of the Minister Marina Silva as a guarantee that finally, the issues regarding the Environment and Sustainable Development would be taken seriously by a Brazilian Government.

2. Portuguese original of letter to Lula

Exmo. Sr. Presidente da República,

As entidades abaixo assinadas assistiram estarrecidas às negociações ocorridas no Senado Federal entre o Ministro Aldo Rebelo e o líder do governo, senador Aloízio Mercadante, e as bancadas da base e da oposição para votar o projeto de lei de Biossegurança enviado por V.Ex.a e aprovado, na sua essência, pela Câmara de Deputados.     As entidades e movimentos estavamos favoraveis ao primeiro projeto encaminhado pelo governo à Camara, mas fomos assitindo ele ser desfigurado passo a passo, sem que os lideres do governo no congresso o defendesse, ao contrario, contribuiram para sua desfiguração.

Agora, no senado, apesar da manifesta oposição da Ministra Marina Silva e da sociedade civil organizada, os representantes do governo fizeram aprovar nas comissões do Senado um substitutivo que contraria totalmente o projeto de lei enviado por V.Ex.a, e que viola de forma flagrante vários preceitos constitucionais.

Mais chocados ainda ficaram as signatárias com a notícia veiculada pela imprensa que V.Ex.a prepara-se para enviar ao Congresso uma Medida Provisória incorporando este mesmo substitutivo inconstitucional e oposto ao projeto que V.Ex.a assinou, sem dar margem à Câmara de Deputados de corrigir as modificações introduzidas pelo Senado no PL de sua autoria e que o desfiguraram totalmente.

A proposta aprovada nas Comissões do Senado e que V.Ex.a  prepara-se para introduzir em uma MP viola o Princípio da Precaução da Convenção da Biodiversidade, convenção assinada pelo Brasil. Ela prefigura a liberação dos transgênicos sem qualquer estudo prévio de impacto ambiental e de risco para a saúde dos consumidores sem que tais produtos tragam qualquer benefício para os produtores e exportadores brasileiros.

V.Ex.a aceitou, sem ouvir opiniões contraditórias, a propaganda pró transgênicos de alguns cientistas da Embrapa, das empresas multinacionais de biotecnologia e dos produtores de soja do Rio Grande do Sul, estes últimos iludidos por resultados aparentes e de curto prazo.

Esperamos ainda que V.Ex.a não amplie a liberação indiscriminada dos transgênicos por medida provisória e que o governo recupere a coerência, defendendo o PL apresentado por V.Ex.a à Câmara de Deputados e garantindo a segurança ambiental, dos consumidores e a soberania nacional, feridas de morte pelo substitutivo mencionado.  Consideramos fundamental, tambem que os estados tenham possibilidade de declarar seus territorios livres de transgênico, se assim seu povo e as assembleias legislativas optarem, como já o fizeram em Santa Catarina, Parana e Goiás.    Bem, achamos fundamental garantir o direito da população ler no rotulo, se o alimento contem  Ogms ou não.  Lei  já aprovada, embora não cumprida pelas industrias, e que agora no projeto dos senadores pretende ser revogada.

As espantosas incorreções e equívocos do governo de V.Ex.a neste tema colocam a sociedade civil organizada em posição de profunda frustração com o seu governo e desiludem os que, no Brasil e no exterior, aplaudiram a nomeação da Ministra Marina Silva como uma garantia de que, finalmente, as questões ambientais e da sustentabilidade do desenvolvimento seriam assumidas por um governo brasileiro.
